CBSA Confirms Guidance Will Not Be Released Prior to September 7, 2026
Buckland is continuing to monitor the anticipated implementation of Canadian counter tariffs on certain U.S.-origin goods expected to take effect September 8, 2026.
On September 4, 2026, the Canada Border Services Agency (CBSA) confirmed that implementation guidance will not be released before September 7, 2026.
This means importers may have very limited time to review and implement the official requirements before the anticipated September 8 effective date.
Current Status
The counter tariffs must first be approved and published through an Order in Council (OIC) before the CBSA can issue its related Customs Notice and implementation guidance.
According to the latest information provided by the Canadian Society of Customs Brokers (CSCB), the CBSA does not expect the required Order in Council to be approved and published prior to September 7, 2026.
As a result, the corresponding CBSA Customs Notice outlining the implementation details is also not expected before that date.
What Importers Should Know
With the anticipated counter tariffs expected to take effect on September 8, 2026, importers may have only a short window to evaluate the final requirements once official guidance is released.
Importers potentially affected should:
- Continue preparing for the anticipated September 8, 2026 effective date
- Review upcoming imports of U.S.-origin goods that may potentially be affected
- Be prepared to quickly review the final Surtax Order and CBSA Customs Notice once published
- Evaluate tariff classification, country of origin, shipment timing, and potential surtax exposure
- Avoid relying on preliminary information as final implementation guidance until the official Order in Council and Customs Notice are released
